[COMPANY LEGAL NAME] (“Crushed”) respects copyright and expects everyone on Crushed to do the same. We respond to notices of alleged infringement that follow the Digital Millennium Copyright Act (17 U.S.C. § 512), and we close the accounts of repeat infringers.
Designated agent
Send copyright notices and counter-notices to our designated agent:
[DMCA AGENT NAME]
[COMPANY LEGAL NAME]
[DMCA AGENT ADDRESS]
Email: [DMCA AGENT EMAIL]
Phone: [DMCA AGENT PHONE]
This address is only for copyright matters. Other reports (for example under-21 content, sales or harassment) go to [CONTACT EMAIL].
Reporting infringement (takedown notice)
Your notice must be in writing and include:
- Your physical or electronic signature (typing your full name works).
- The copyrighted work you believe was infringed — or, if several, a representative list.
- The exact location of the infringing material on Crushed (the page URL and, for a video or live stream, a description or timestamp) so we can find it.
- Your name, mailing address, phone number and email.
- A statement that you have a good-faith belief the use isn’t authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
When we receive a complete notice we’ll remove or disable access to the material promptly, tell the person who posted it, and give them a copy of the notice (which includes your contact details). Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. § 512(f). Consider fair use before sending a notice.
Responding to a takedown (counter-notice)
If your content was removed and you believe that was a mistake or misidentification, you can send our designated agent a counter-notice that includes:
- Your physical or electronic signature.
- The material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you’re outside the U.S., any judicial district where Crushed may be found), and that you’ll accept service of process from the person who sent the original notice or their agent.
We’ll send your counter-notice to the person who filed the original notice. If they don’t tell us within 10 business days that they’ve filed a court action to restrain the infringement, we may restore the material 10 to 14 business days after we received your counter-notice.
Repeat infringers
We track valid notices against each account. Accounts and creator pages that are the subject of repeated valid notices will be suspended or closed, and we may act sooner where infringement is clear or deliberate.
