Terms of Service

Effective October 23, 2026 · Version 2026-10-23

Draft — pending legal review. This document is a working draft and may change before it takes effect.

These Terms of Service (“Terms”) are a contract between you and [COMPANY LEGAL NAME], [STATE] [ENTITY TYPE] (“Crushed,” “we,” “us”). They cover your use of crushed.app and everything on it: the newsroom, data and rankings, dispensary and brand listings, The Plug, the Stash, creator pages, live streams and Crushed Studio (together, the “Service”). By using the Service you agree to these Terms and to our Privacy Policy and Community Guidelines. If you don’t agree, don’t use the Service.

1. You must be 21 or older

The Service is about cannabis and is only for adults 21 and older. By using it you confirm you are at least 21 and that viewing cannabis content is legal where you are. We may ask you to confirm your age and may close any account we believe belongs to someone under 21.

2. Crushed is information, not a store

Crushed does not sell, deliver, or facilitate the sale of cannabis or any controlled substance. Product listings, prices, menus, deals, sales estimates and rankings are informational, come from third parties (including dispensary menus and data partners), and may be wrong or out of date. Always confirm details with the licensed retailer. Nothing on the Service is medical, legal or financial advice. Cannabis remains illegal under U.S. federal law and its legal status varies by state; you are responsible for following the laws that apply to you.

3. Accounts

Some features need an account, an access code, or a private link (for example a Stash account, a brand or dispensary dashboard, or a Studio invite link). Keep your credentials and private links to yourself — anyone holding them can act as you. Give us accurate information and tell us at [CONTACT EMAIL] if you think your account has been compromised. You’re responsible for what happens under your account.

4. Your content

You own what you post (videos, posts, comments, profile details, live streams and anything else — “Your Content”). You give Crushed a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transcode, display, distribute and promote Your Content on and in connection with the Service (including in previews, the Channel reel, social posts and marketing for Crushed), and to make technical changes needed to do that. This license ends when you delete Your Content or your account, except for copies kept in backups for a limited time, content others have already shared, or where we need to keep it for legal reasons.

You promise that you have the rights to everything you post, that it follows these Terms and the Community Guidelines, and that it doesn’t infringe anyone else’s rights. Creators who publish a page also agree to the Creator Agreement.

5. What you can’t do

  • Buy, sell, offer, or arrange the sale or delivery of cannabis or any controlled substance.
  • Post or share anything involving or aimed at anyone under 21.
  • Break the law, or help anyone else break it.
  • Harass, threaten, impersonate or dox anyone.
  • Post content you don’t have the rights to.
  • Scrape, copy or resell our data, rankings or listings at scale without written permission.
  • Interfere with the Service: probing, hacking, overloading, spreading malware, or getting around rate limits, age gates or access controls.
  • Use the Service to send spam or unauthorized advertising.

6. Moderation

We can review, remove, hide or restrict any content, and suspend or close any account or page, if we believe it breaks these Terms, the Community Guidelines or the law, or creates risk for Crushed or others. We’re not obligated to monitor content, and we may act with or without notice. You can report content using the Report link on creator pages or by emailing [CONTACT EMAIL]. Copyright complaints follow our DMCA Policy.

7. Our content and data

The Service’s design, software, original articles, rankings, and compilations of data are owned by Crushed or our licensors and protected by law. You can view and share links to them for personal, non-commercial use. Anything else needs our written permission. Third-party marks belong to their owners.

8. Third-party services and links

The Service links to and embeds third-party sites and content (dispensary menus, YouTube, Instagram, TikTok and others). We don’t control them and aren’t responsible for them; their own terms apply.

9. Paid features

Crushed is currently free to use. If we introduce paid features such as creator memberships, we’ll publish their terms, including pricing, billing and refunds, before charging anyone.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, CRUSHED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We don’t promise the Service will be uninterrupted, error-free or secure, or that any information on it is accurate. Content posted by users and creators is theirs, not ours, and we don’t endorse it.

11. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, CRUSHED WON’T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $100 OR WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some places don’t allow these limits, so they may not all apply to you.

12. Indemnity

If someone brings a claim against Crushed because of Your Content or your breach of these Terms or the law, you agree to defend and indemnify Crushed against it, including reasonable attorneys’ fees.

13. Ending things

You can stop using the Service at any time and ask us to delete your account. We may suspend or end your access at any time for any reason, including a breach of these Terms. Sections that by their nature should survive (like content licenses already granted for shared content, disclaimers, limits of liability, indemnity and disputes) survive.

14. Disputes

These Terms are governed by the laws of [GOVERNING LAW STATE], without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in [VENUE COUNTY], [GOVERNING LAW STATE], and you and Crushed consent to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally.

15. Changes

We may update these Terms. When we do, we’ll change the effective date above, and for material changes we’ll give notice on the site or by email. Using the Service after a change takes effect means you accept the updated Terms.
