Rhode Island tells hemp shops they can keep THC inventory, just not sell it, as the federal cutoff nears

A revised state bulletin swaps a remove-it-or-be-fined order for a quarantine, with an inventory report due before the December 11 federal deadline.

Products above the new federal hemp potency limit become illegal nationwide on December 11, after Congress pushed the original November 12 date back a month in a September funding bill. Rhode Island's Cannabis Control Commission has now eased its own approach for hemp licensees ahead of that date.

An October 8 bulletin, emailed to all 201 state hemp licensees the next day, lets businesses quarantine inventory with more than 0.4 mg of total THC per container instead of removing it. Quarantined product cannot be processed, moved, distributed or sold unless federal or state authorities explicitly allow it. Licensees must file an inventory report by December 4, and after December 11 nothing can be added to or removed from quarantine. Destruction is available at any time but must be supervised by the state Cannabis Office, and regulators can audit inventory. A September bulletin had said noncompliant product must be removed or face fines.

Regulators say they are still working out how the federal change interacts with state rules. Growers and distributors are asking whether they would need fresh approval to resume sales if federal law shifts after the deadline.

Takeaway for hemp operators: quarantine buys time but not revenue, and the paperwork deadline arrives a week before the ban. Count what is on your shelves now, decide what you would rather destroy than carry, and ask your state regulator for written answers on restart rules.
