Walk into almost any dispensary in a mature, legalized cannabis market, and you'll see top-shelf flower boasting THC percentages of 32%, 35%, or even 38%. The math doesn't really add up. Cannabis flower is composed mostly of plant matter — cellulose, water, proteins, minerals — along with cannabinoids and terpenes, and botanists and agronomists generally agree the biological maximum for THC production in a cannabis plant hovers around 35% of dry weight. A label claiming 38% THC implies that nearly four-tenths of the physical bud you're holding is pure, isolated THC, which is biologically improbable bordering on impossible for raw flower.

So how are these numbers ending up on state-mandated compliance labels? The answer is a systemic regulatory failure known as "lab shopping" and the THC inflation it produces — an open secret in the industry that consumers keep paying a premium for.

In legal cannabis markets, cultivators are required to send representative samples of their harvests to independent, state-licensed labs, which run safety screens for pesticides, heavy metals, residual solvents, and mold alongside potency testing for THC and CBD. The flaw is in the incentives: consumers have been conditioned to equate higher THC percentages with higher quality and stronger effects, so dispensaries are willing to pay significantly more wholesale for flower testing at 28% THC than for the same flower testing at 22%.
